The City of Burlington has created a set of Design Guidelines for Patios on Public Lands. These new guidelines:

  • provide design direction to business operators,
  • include accessibility requirements for all patios,
  • provide Information on alcohol service and AGCO regulations,
  • include instructions of how operators can apply with step-by-step information on how applications will be processed,
  • provide guidance related to fencing, lighting, umbrellas and canopies,
  • include Fire Safety Requirements and
  • include an application checklist.

We introduced patios in 2015 under the Pop-Up Patio Program in the downtown core. During the City’s COVID-19 response, the Temporary Patio Program was approved by Council and ran until October 2023. On Feb. 13, 2024, City Council approved staff report PL-05-24 and recommendation to establish a permanent city-wide seasonal outdoor patio program beginning in 2024.

    On Feb. 13, City Council approved these recommendations:

    • the establishment of a permanent city-wide seasonal outdoor patio program beginning in 2024 as outlined in community planning department report PL-05-24;
    • a fee structure for the permanent city-wide seasonal outdoor patio program as detailed in revised Option 1 (included in the Revised COW Agenda dated Feb. 2, 2024) and remove the fees related to on-street barriers (capital and operating);
    • Amend the seasonal patio guidelines application requirement to include liability insurance in the amount of $2M
    • Direct the Director of Community Planning to report back in Q4 2024, following the implementation and operation of the 2024 patio program to evaluate program outcomes and continued implementation of the permanent city-wide seasonal outdoor patio program (SD-01-24);
    • Direct the Director of Community Planning to prepare any necessary bylaws to create a permanent city-wide seasonal outdoor patio program and implement a fee structure,
    • Enact By-law 2020.463 as contained in Appendix A of community planning department report PL-05-24; and
    • Endorse, in principle, the Seasonal Patio Guidelines for Outdoor Patios on Public Lands as set out in Appendix B to community planning department report PL-05-24; and
    • Delegate authority to approve the Seasonal Patio Guidelines for Outdoor Patios on Public Lands as set out in Appendix B to community planning department report PL-05-24, and any amendments, to the Executive Director of Community Planning, Regulation & Mobility, or designate.

    On February 5th, staff are bringing a report to the Committee of the Whole to present recommendations for the launch of a new permanent city-wide seasonal outdoor patio program in 2024.

    The purpose of this report is to provide a response to the motion from the Community Planning, Regulation and Mobility Committee Meeting of Dec. 5, 2023, to: Refer community planning department report PL-63-23 regarding the City of Burlington Outdoor Patio Program back to staff for additional information and further analysis and report back to the February 2024 committee cycle.

  • Permanent City-wide seasonal patio update

    On December 5th, staff are bringing a report to the Community Planning, Regulation and Mobility Committee to present recommendations for the launch of a new permanent city-wide seasonal outdoor patio program in 2024. This report will include a proposed amendment Zoning By-law 2020, as well as two sets of design guidelines for patios on public and private lands respectively.

    The report will be available for public review on Nov. 24, 2023. The reports will be available at www.burlington.ca/calendar by searching for the Dec. 5 meeting date of the Community Planning, Regulation and Mobility Committee.   • We're at the Food for Feedback event on September 16

  • Applications now being accepted for 2023 spring and summer temporary patio permits

    Applications for the 2023 temporary patio program are being accepted starting March 22. Business owner/operators that would like to install a temporary patio on municipal property in the downtown during the 2023 patio season are encouraged to apply online at burlington.ca/patios as soon as possible. Application fees for the 2023 temporary patio program are being waived once again this year.

    City staff are committed to reviewing temporary patio program applications and working collaboratively with applicants to help local restaurants and businesses understand how they can safely operate an outdoor patio during the 2023 patio season.

    At Council on Tuesday, March 21, a start date of April 15, 2023 for the continuation of the temporary patio program in 2023 was approved. The temporary patio season for 2023 will run from April 15 to Oct. 31, 2023.

  • Update report on the outdoor patio program

    This report speaks to the continuation of the existing Temporary Outdoor Patio Program (2020-22) for the 2023 patio season and recommends approval of a new temporary use by-law and by-law to restrict the common law right of passage by the public over a highway, which will continue to authorize the approval of temporary outdoor patios on both private and public property in a manner that is streamlined and eases zoning restrictions for such uses.

  • Interim Recommendation Report to Committee and Council

    Thanks to both the public and business owners for providing feedback on the Outdoor Patio Program.

    An interim recommendation report is going to the Community Planning, Regulation and Mobility Committee on December 6, 2022 and to Burlington City Council on December 13, 2022.

    Read the report and supporting document with guidelines.

    After Council and the public have provided feedback on the interim guidelines, final guidelines and any amended by-laws will be adjusted in time for the spring 2023 patio season.
